These terms govern Clanker Cloud accounts, desktop downloads, and related services. Version 2026-09-18.

By signing in, creating an account, downloading, installing, opening, or using Clanker Cloud, you agree to these terms and the Privacy Policy on behalf of yourself or the organization you represent.
Use of the service
You may use Clanker Cloud only in compliance with applicable law and these terms. You are responsible for activity performed through your account, the systems you connect, and the credentials you provide to the product.
Accounts and security
You must provide accurate account information and keep your password and backup code under your control. If you lose both, we may not be able to restore access. You are responsible for actions taken from your account until you delete it or contact us about unauthorized use.
Infrastructure actions and local credentials
Clanker Cloud helps you inspect, plan, and execute infrastructure work, but you remain responsible for reviewing actions before approving them. You are responsible for the cloud resources, costs, outages, security changes, and data exposure that result from using the service with your own environments and credentials.
Secretary, assistants, and remote actions
Clanker Secretary, Cerebro, sandboxes, agents, and other assistants can generate instructions and, when you enable or approve execution, take actions on computers, files, accounts, infrastructure, communications, or third-party systems. Their output may be inaccurate, destructive, delayed, incomplete, or different from what you intended. You authorize each connection and action, must review outputs and maintain backups and access controls appropriate to the risk, and remain responsible for the consequences. To the maximum extent permitted by law, Nov 1337 Labs is not responsible for damage, loss, disclosure, cost, outage, legal consequence, or third-party claim caused by an assistant action, remote instruction, generated command, or your decision to run or rely on it.
Standard and contracted protected plans
Lite, Pro and new Business subscriptions use the Standard shared service. Business data controls and Gemini ZDR require separate enrollment, provider verification and activation. Business subscribers may use normal models and features subject to plan limits and credits. The restricted data profile requires separate enrollment and agreement; purchasing Business does not enroll you or pause inference. A subscription purchase alone does not activate Gemini ZDR; the Workspace status must show active. Missing or expired verification stops affected inference without fallback to Standard providers. Existing protected or sovereign accounts retain their separate restrictions. Enterprise options, including dedicated or customer-cloud infrastructure, residency, customer-managed keys, advanced identity, service levels, and regulated-data agreements, require an identified scope, written agreement, and verified activation. A plan name or region preference is not a certification or a promise that your use satisfies a particular law.
Business data controls and deletion
Before activation of the restricted Business data profile, the owner or an authorized organization administrator must explicitly accept its Business agreement. This additional agreement is not required to use a Business subscription with normal Standard processing. The following controls apply only after that separate enrollment. We record the accepting actor, version and timestamp; acceptance does not activate provider ZDR. Business controls belong to the data-owning account or organization. Any account may create or join a normal organization. The original creator’s active Business subscription covers its Business features; organization credits and spending limits remain separate and the creator’s credits are not duplicated. Changing admins does not change the sponsor. If ZDR is enabled, every member, including owners, admins, billing members and contractor guests, needs their own Business eligibility. All existing members must qualify before enrollment; ineligible accounts cannot join. Loss of eligibility suspends that member’s access until restored, without deleting organization content. If the creator’s eligibility lapses, organization Business inference stops; restrictions and retention remain. Owners and authorized organization administrators manage memory and learning, share links, managed connected tools, and project retention. These controls start with memory, share links, and managed connections disabled, content diagnostics off, and saved data kept until deleted. Automatic project retention may be set to 30, 90, or 365 days. It deletes whole projects and their owned content, even if recently edited. Existing projects receive the selected interval from the policy change; new projects use their creation date. General, unassigned content, global Agents and Skills require explicit deletion. Export anything you need before deletion. Cleanup may take time and recovery copies expire separately; a started deletion cannot be cancelled by changing the policy. Restrictions and scheduled retention remain after downgrade. Imported recipient copies and data sent to customer-selected external services are outside these deletion controls. Managed-connection controls are not a network firewall for customer scripts or computers. Some features, including voice, authenticated Marketplace features, media analysis, AI indexing, App builds and managed BYOA inference, are unavailable until compatible processing paths exist.
Clanker Cloud LLM provider data
Hosted models receive the prompts, context, and files you supply for an approved request. Workspace stores saved conversations, files, memory, outputs, and execution state independently of model-provider retention. Business Gemini ZDR applies only to the approved stateless Gemini requests in the verified Vertex AI processing profile, under the applicable Google Cloud terms. It does not mean zero storage throughout Clanker Cloud or remove billing, security, or legally required records. Requests within an activated restricted Business data profile stop if provider verification or subscription eligibility lapses. Ordinary Business subscriptions continue using Standard processing until ZDR is activated. Provider grounding, persistent provider sessions, and unapproved model paths are unavailable under this profile. Customer-selected external services and code remain subject to their own terms and controls.
Enterprise documents and order of precedence
A signed order, Data Processing Addendum, business associate agreement, CJIS agreement, service level, or security schedule applies only to the customer and environment it identifies. If a signed enterprise document conflicts with these online terms, that signed document controls for the conflict. Marketing copy, a plan purchase, or an account setting does not amend a signed agreement or activate a protected environment.
Beta software and downloads
By downloading, installing, opening, or using a desktop build, you agree to these terms and the Privacy Policy. Desktop builds, previews, and beta features may be incomplete, change without notice, or stop working. They are provided as-is for evaluation and operational use at your own risk.
Acceptable use
You may not use the service to break the law, interfere with other systems without authorization, abuse shared infrastructure, reverse engineer non-public service components where prohibited by law, or attempt to bypass account, rate, or access controls.
Termination
We may suspend or terminate access if we believe your use creates legal, security, operational, or abuse risk. You may stop using the service at any time and delete your account from the account page.
Disclaimers and liability
The service, its models, assistants, remote-control features, commands, plans, and outputs are provided on an as-is and as-available basis without warranties. To the maximum extent allowed by law, Nov 1337 Labs is not liable for direct or indirect, incidental, special, consequential, exemplary, or lost-profit damages, or for loss, corruption, or disclosure of data, credentials, revenue, evidence, communications, systems, or infrastructure caused by use of or reliance on the service. Rights and liabilities that cannot lawfully be excluded remain unaffected.
Changes to these terms
We may update these terms over time. We will publish the new version and date here. Account creation records affirmative acceptance of a specific version. If a material update requires renewed acceptance or contractual notice, we will request it through the account or customer contact; continued use alone does not replace a required affirmative acceptance.
